The Justice of La Plata set a date for the oral debate against a doctor accused of serious injuries after a cosmetic intervention. The victim suffered health complications similar to those of the renowned deceased model.
The Correctional Court No. 2 of The Silver determined the beginning of the oral and public trial against the doctor Claudia Marisa Benitezaccused of the crime of serious injuries within the framework of a cosmetic surgery performed in a clinic in the city. The complainant, whose identity is reserved under the nickname «Silvina Luna from La Plata»maintains that after an intervention involving the application of fillers, he began to suffer from serious chronic health conditions.
The judicial process seeks to determine the professional responsibility of the doctor in the physical deterioration of the patient. The case has generated great expectations in the region due to the clinical and legal similarities with the case that convicted the doctor. Aníbal Lotocki due to the use of prohibited substances or poor applications in body shaping procedures.
According to the submission to trial, the events under investigation occurred in the year 2014when the patient underwent an intervention for the application of polymethylmethacrylate (PMMA). After the operation, the victim developed a hypercalcemia and one chronic kidney failurea condition that forces her to undergo permanent medical treatments to maintain her organic function.
The prosecution and the complaint will present during the hearings more than 15 testimoniesamong which medical experts from the La Plata Expert Advisory and nephrology specialists. Technical reports indicate that the injected material would have migrated in the body, causing granulomas and subsequent kidney failure, a chronology of damage that spanned more than 9 years until the current instance.
This trial takes place in a climate of high social sensitivity regarding the mala praxis aesthetic in Argentina. The direct antecedent is the death of the model Silvina Luna in August 2023who lost his life after a decade-long battle with kidney failure resulting from similar surgery.
In La Plata, the case of the patient from La Plata is considered the most advanced file against local professionals for the use of filler substances. The defense of the accused doctor, for its part, maintains that the procedure was carried out under biosafety standards and that the complications could be multi-causal, an argument that will be debated before the intervening magistrate.
The oral debate is scheduled to take place during the months of April and May 2026. If found guilty, the doctor could face a sentence of up to 6 years in prison and special disqualification from practicing medicine for twice the length of the sentence. The resolution of this case will set a key precedent for other files for aesthetic injuries that are processed in the Buenos Aires courts.
