The Government seeks to regulate the labor reform before the end of April with a clear objective: to protect it against possible judicial setbacks. The decision comes after the ruling of the National Court of First Instance of Labor No. 63 on March 13, which raised alerts in the Casa Rosada.

The strategy will be coordinated between the Treasury Attorney General’s Office and the Legal and Technical Secretariat. The objective is to channel judicial presentations in the Contentious Administrative jurisdiction and, ultimately, take the definition to the Supreme Court of Justice.

The ruling party trusts in the recent records of the highest court, which has already issued rulings favorable to the Government, such as the rejection of the demands against DNU 70/2023 (Bases Law) and the resolution on the legislative deadlines of Congress. They also mention the ruling that ratified the conviction of former president Cristina Fernández de Kirchner, interpreted by some sectors as a sign of harmony with the Executive.

According to official sources, the regulations will not imply substantive changes. The reform is partially stopped by a ruling by the Labor Court that gave rise to a CGT protection and suspended 82 articles.

Far from retreating, the Government is moving forward with an administrative scheme that involves the Treasury Attorney General’s Office, the Legal and Technical Secretariat, the State Deregulation and Transformation area, ARCA and the Ministry of Labor.

Among the central axes that are sought to be consolidated are the Labor Assistance Fund (FAL), new payment schemes for benefits without a dependency relationship, labor registration mechanisms and social security benefits for temporary contracts.

The regulatory decree aims to close two key fronts: how the law will be applied to pre-existing labor relations and how the new procedures will be processed, with the intention that the last word remains in the hands of the Supreme Court.

In parallel, the CGT is preparing to resist both in court and on the street. The legal team of the labor union—made up of Pablo Topet, Hugo Antonio Moyano, Marta Pujadas and Federico West Ocampo—is already analyzing the strategy to stop the official advance.

The economic context is not supportive. Industrial activity continues to decline: according to the Argentine Industrial Union, it fell 3% in February and remains stagnant, with levels below those recorded in 2022 and 2023.

On the labor front, the outlook is also adverse. Data from INDEC show that unemployment grew again and closed 2025 at 7.5%, with increases both in the year-on-year comparison and in recent evolution.
